Former Attorney General of Delaware and former Delaware Superior Court Judge, M. Jane Brady brings a dual-perspective understanding to clients, helping them anticipate and navigate regulatory investigations, enforcement actions and high-stakes litigation.
An accomplished litigator, she has tried over 100 jury trials in her career and handled more than 40 appeals in the Delaware Supreme Court, bringing a wealth of courtroom experience that informs her strategy and counsel.
In her private practice, Jane assists clients with a comprehensive approach that includes advising on corporate governance, evaluating cases, developing trial strategy, preparing witnesses for testimony and mediation, engaging in policy advocacy, and advising on complex constitutional challenges and issues – all the way to the Delaware Supreme Court. Most recently in her practice she has challenged the state to comply with its own rules, laws and constitution.
Jane has a national profile. She was in private practice until her election as the first woman Attorney General of Delaware in 1994. She served three terms as State AG and was instrumental in developing legal support for victims of crime, interpreting and expanding FOIA (the Freedom of Information Act), and modernizing Delaware's response to child abuse, senior victimization, and animal cruelty.
In 2004, she chaired the Executive Working Group comprised of Attorneys General, District Attorneys and United States Attorneys to discuss law enforcement and prosecution issues of mutual concern. She was also a founding member of the Republican Attorneys General Association (RAGA).
From 2005 until 2017, Jane served as Judge of the Superior Court of Delaware, where she presided over business disputes, complex insurance coverage matters, criminal cases and contract dispute matters, as well as administrative appeals.
Nationally, Jane has testified before Congress about elderly victimization and has been part of several significant criminal justice efforts. She served on the ABA Study Group on Prosecutor Accountability, Performance Measures and Best Practices, chaired by Edwin Meese, III, the former U.S. Attorney General. Jane served as a Liaison from the National Association of Attorneys General to several other national committees, including the American Bar Association’s Criminal Justice Section Council, the American Bar Association’s Standards Task Force on Biological Evidence and the Advisory Committee of the American Bar Association’s National Symposium on the American Jury System.
Jane currently serves as Chair of A Better Delaware, a non-partisan public policy organization and political advocacy organization. She also serves on the Board of Directors of the Delaware Safety Council and the Blue-Gold Basketball Tournament.
Jane has been a frequent commentator in the regional and national media on issues relating to criminal justice, corporate governance, and victimization. She has been a guest on CSPAN, National Public Radio’s “Talk of the Nation” and “Justice Talking” programs, on CNN’s “CNN Saturday” television program, on the CN8 program, “It’s Your Call with Lynn Doyle” and on CN8’s “Your Morning” program.
